Access to our Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Website without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

From time to time, we may restrict access to some parts of our Website, or our entire Website, to users who have registered with us.

By using the Website to book a ride or perform any other activities, you agree that you will only use, reproduce and print materials comprising the results of such searches for your own personal, non-commercial purposes. You must only use the contact details provided by private drivers to contact them in connection with a genuine enquiry relating to the booking of ride in question.

Pages contained in the Website may contain technical inaccuracies and typographical errors. The information in these pages may be updated from time to time and may at times be out of date. We do not accept responsibility for keeping the information up to date or liability for any failure to do so.

The material on the Website is only for information purposes. It does not constitute advice and you should not rely on any material on the Website to make (or refrain from making) any decision or take (or refrain from taking) any action.

The Website contains material submitted and created by private and trade dealers and other third parties. We exclude all liability for any illegality arising from or error, omission or inaccuracy in such material.

You shall maintain in confidence all information and data relating to LINK, its services, products, business affairs, marketing and promotion plans or other operations and its associated companies which are disclosed to you by or on behalf of LINK (whether orally or in writing and whether before, on or after the date of this Agreement) or which are otherwise directly or indirectly acquired by you from LINK, or any of its affiliated companies, or created in the course of this Agreement. You shall further ensure that you, your officers, employees and agents only use such confidential information in order to perform the Services, and shall not without the LINK’s prior written consent, disclose such information to any third-party nor use it for any other purpose. You shall only disclose such information to such officers, employees and agents as need to know it to fulfil its obligations under this Agreement.

You agree to take all reasonable measures to protect the secrecy of and avoid disclosure or use of Confidential Information of LINK in order to prevent it from falling into the public domain. Notwithstanding the above, you shall not have liability to LINK with regard to any Confidential Information which you can prove: was in the public domain at the time it was disclosed by LINK or has entered the public domain through no fault of yours; was known to you, without restriction, at the time of disclosure, as demonstrated by files in existence at the time of disclosure; is disclosed with the prior written approval of LINK; becomes known to you, without restriction, from a source other than LINK without breach of this Agreement by you and otherwise not in violation of LINK’s rights; or is disclosed pursuant to the order or requirement of a court, administrative agency, or other governmental body; provided, however, that you shall provide prompt notice of such court order or requirement to LINK to enable LINK to seek a protective order or otherwise prevent or restrict such disclosure.

We give no warranties, conditions, guarantees or representations, express or implied, as to:-

• the completeness or accuracy of the advice and information contained on the Website or any associated website;

• the driver's personal details, including but not limited to the ownership, quality, authenticity of the vehicle he/she provided to us. Whilst we use reasonable efforts to identify and remove fraudulent drivers, we cannot guarantee to identify all fraudulent drivers on the Website.

• the results of any search of our database or circumstances where there is a limited number of available drivers selected by the search on our database which might meet the searcher's requirements.

Prices and Payments

LINK payment system is a system under which a rider makes a suggestion for a ride’s price and the ride request confirms only if a driver accepts this quoted price. You agree that if your offer is accepted, LINK will confirm the reservation and charge the entire amount of the ride, including applicable taxes and fees. The price you name is per ride. The "median ride price" which we may display to you is the median of the rates transportation network companies are offering to the general public for the exact or approximate distance you selected. These rates are based on the time you requested a ride and the area you selected. We make no guarantee or warranty, with respect to the accuracy or completeness of the data used or provided.

You agree that this Agreement shall be subject to all prevailing statutory taxes, duties, fees, charges and/or costs, however denominated, as may be in force and in connection with any future taxes that may be introduced at any point of time. You further agree to use your best efforts to do everything necessary and required by the relevant laws to enable, assist and/or defend the Company to claim or verify any input tax credit, set off, rebate or refund in respect of any taxes paid or payable in connection with the Services supplied under this Agreement.

LINK may charge a fee to the driver for the use of the Services. LINK may at any time propose changes to the fee.

To refund is the amount of the fee from cancelled orders, which the driver will receive back, each fee will be refunded separately in 30 days after the order was cancelled.

The fee will be deducted when the car is delivered to point "A", as well as when you call the passenger before pressing the "I'm here" button. The fee will be refunded if the passenger cancels the trip or if the passenger never appeared. In this case you should press the "Passenger did not come out" button. Refunds for such rides will be made in 30 days after the manager confirms the information.
ATTENTION: In case the passenger cancels the ride or does not come out, be sure to complete the order by clicking the "Passenger did not come out" button. If you cancel your order by clicking the "Complaint" button, no refund will be made. In case of cancellation of the order by the driver happens after a call to the passenger, the fee is not refunded.

Copyright and trade marks

All rights, including copyright, in the content of the web pages, in the photographs of any vehicles displayed on the Website and all database rights in our database of vehicles, are owned or controlled for these purposes by us.

All trademarks, names and logos are the proprietary marks of LINK or of our associated companies. Marks identifying third parties are owned or licensed by those third parties or their associated companies. No conditions within these terms use confers on you any licence or right under any trademarks, names or logos.

We are not liable for failure to perform any of our obligations under these terms of use caused by matters beyond our reasonable control.

Unless, by exemption permitted within these terms of use, you may not copy, reproduce, redistribute, download, republish, transmit, display, adapt, alter, create derivative works from or otherwise extract or re-utilise any of the contents of the Website. In particular, you must not cache any of the contents for access by third parties, nor mirror or frame any of the content of the Website nor incorporate it into another website without our express written permission.

Liability

The material displayed on our Website is provided without any guarantees, conditions or warranties as to its accuracy and as otherwise excluded in these terms of use. You understand and acknowledge that in using the Service, you may be exposed to Content that is factually inaccurate, offensive, indecent, fraudulent or otherwise objectionable to you. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against LINK with respect to any such Content.

To the extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude:

All conditions, warranties and other terms which might otherwise by implied by statute.

Any liability for a direct, indirect or consequential loss or damage incurred by any user in connection with our Website or in connection with the use, inability to use, or results of the use of our Website, any websites linked to it and any materials posted on it, including without limitation any liability for:

• Loss of income or revenue;

• loss of business;

• loss of profits or contracts;

• loss of anticipated savings;

• loss of data;

• loss of goodwill;

• wasted management or office time; and

• for any other loss or damage of any kind, howsoever arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

We will need to carry out routine maintenance and servicing of our servers and equipment from time to time. While we will seek to keep disruption to a minimum we cannot guarantee that the Website will be continuously available on-line. We therefore provide the Website on an "as is" and "as available" basis.

We make no warranty that the Website ( or associated Websites) is free from computer viruses or any other malicious or impairing computer programs. It is your responsibility to ensure that you use appropriate virus checking software.

The company does not and will not assess nor monitor the suitability, legality, ability, movement or location of any third party providers including third party transportation providers, advertisers and/or sponsors and you expressly waive and release the company from any and all liability, claims or damages arising from or in any way related to the third party providers including third party transportation providers, advertisers and/or sponsors. LINK will not be a party to disputes, negotiations of disputes between you and such third party providers including third party transportation providers, advertisers and/or sponsors.

We cannot and will not play any role in managing payments between you and the third party providers, including third party transportation providers, advertisers and/or sponsors. Responsibility for the decisions you make regarding services and products offered via the service, software and/or the application (with all its implications) rests solely with and on you. You expressly waive and release the company from any and all liability, claims, causes of action, or damages arising from your use of the service, software and/or the application, or in any way related to the third parties including third party transportation providers, advertisers and/or sponsors introduced to you by the service, software and/or the application.

The quality of the third party transportation services scheduled through the use of the service is entirely the responsibility of the third party transportation provider who ultimately provides such transportation services to you. You understand, therefore, that by using the service, you may be exposed to transportation that is potentially dangerous, offensive, harmful to minors, unsafe or otherwise objectionable, and that you use the service at your own risk.

We are not liable for any failure to perform any of our obligations under these terms of use caused by matters beyond our reasonable control.

UNDER NO CIRCUMSTANCE SHALL THE COMPANY AND/OR ITS LICENSORS BE LIABLE TO YOU OR ANYONE FOR ANY DIRECT, INDIRECT, PUNITIVE, ECONOMIC, FUTURE SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES OR LOSSES OF ANY TYPE OR KIND (INCLUDING PERSONAL INJURY, EMOTIONAL DISTRESS AND LOSS OF DATA, GOODS, REVENUE, PROFITS, USE OR OTHER ECONOMIC ADVANTAGE). LINK AND/OR ITS LICENSORS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE OR INJURY WHICH MAY BE INCURRED BY OR CAUSED TO YOU OR TO ANY PERSON FOR WHOM YOU HAVE BOOKED THE SERVICE FOR, INCLUDING BUT NOT LIMITED TO LOSS, DAMAGE OR INJURY ARISING OUT OF, OR IN ANY WAY CONNECTED WITH THE SERVICE, APPLICATION AND/OR THE SOFTWARE, INCLUDING BUT NOT LIMITED TO THE USE OR INABILITY TO USE THE SERVICE, APPLICATION AND/OR THE SOFTWARE, ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY ADVERTISING, OR AS A RESULT OF ANY RELATIONSHIP OR TRANSACTION BETWEEN YOU AND ANY THIRD PARTY PROVIDER, ADVERTISER OR SPONSOR WHOSE ADVERTISING APPEARS ON THE WEBSITE OR IS REFERRED TO BY THE SERVICE, APPLICATION AND/OR THE SOFTWARE, EVEN IF THE COMPANY AND/OR ITS LICENSORS HAVE BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

By agreeing to the Terms of Use upon using the Service, you agree that you shall defend, indemnify and hold LINK, its officers, directors, members, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with: (a) your use of the Service, Software and/or the Application, your dealing with the third party Transportation Providers, third party providers, partners, advertisers and/or sponsors, or (b) your violation or breach of any of the Terms of Use or any applicable law or regulation, whether or not referenced herein or (c) your violation of any rights of any third party, including third party Transportation Providers arranged via the Service, or (d) your use or misuse of the Service, Software and/or the Application.

Our inclusion of hypertext links to such websites does not imply any endorsement of the material contained on the websites or of the owners.

Registration details

To gain access to certain services on the Website you will need to register (free of charge). As part of the registration process, you will be given a username and password. You agree that the information supplied with your registration will be truthful, accurate and complete. You also agree that you will not attempt to register in the name of any other individual nor will you adopt any username which we deem to be offensive. All personal information supplied by you as part of the registration process will be protected in line with our Privacy Policy.

The company makes no representation, warranty, or guarantee as to the reliability, safety, timeliness, quality, suitability or availability of any services, including but not limited to the third party transportation services obtained by or from third parties through the use of the service, application and/or the software. You acknowledge and agree that the entire risk arising out of your use of the service, and any third party services, including but not limited to the third party transportation services remains solely and absolutely with you and you shall have no recourse whatsoever to the company.

The service, application and/or the software may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications including the device used by you or the third party transportation provider being faulty, not connected, out of range, switched off or not functioning. The company is not responsible for any delays, delivery failures, damages or losses resulting from such problems.

General

We reserve the right to assign or subcontract any or all of our rights and obligations under these terms of use to a third party. If we exercise this right, we shall name the assignee or subcontractor on the Website and you will be entitled to terminate the account within 5 working days. You may not without our prior written consent assign or dispose of any rights or obligations arising under these terms of use.

These terms of use of access together with our privacy policy contain the entire agreement and understanding between the parties relating to the Website, and supersede any and all prior agreements, arrangements, statements and understandings, except for any fraud or fraudulent representation by either party. We exclude all representations and warranties relating to access to use of the Website, whether they are statutory or otherwise, as far as is possible by law.

We may give notice to you by email, a posting on the Site, or other reasonable means. You must give notice to us in writing via email or as otherwise expressly provided.

Our services are not suitable for those under sixteen years of age and, as such, by using our Website you represent that you are at least sixteen years of age. Persons who are at least sixteen years of age but under the age of eighteen years of age may only use the Website with legal parental or guardian consent.

You may only access the Service using authorized means. It is your responsibility to check and ensure that you have downloaded the correct Software for your device. LINK is not liable if you do not have a compatible device or if you have downloaded the wrong version of the Software to your device. LINK reserves the right not to permit you to use the Service should you use the Application and/or the Software with an incompatible or unauthorized device or for purposes other than which the Software and/or the Application is intended to be used.

No waiver of any term of the Agreement shall be deemed a further or continuing waiver of such term or any other term, and any failure to assert any right or provision under the Agreement shall not constitute a waiver of such term. If any of these terms of use shall be held to be invalid or unenforceable, it shall not affect the enforceability of any of the remaining provisions.

These terms of use shall be governed by and in accordance with English law and subject to the exclusive jurisdiction of the English Courts.

If you do not agree to obey these terms of use you must stop using the Website immediately.
